Towards more possibilities for Member States to regulate the cultivation of GMO's.

Nieuwe Europese wetgeving over ggo’s op komst: schuift de EU de hete aardappel door naar de lidstaten?

Waar wil de EU naartoe als het gaat over ggo’s? Het Europees Parlement zal de komende maanden het strijdtoneel vormen voor een discussie over een voorgestelde wijziging in de wetgeving met betrekking tot genetisch gemodificeerde gewassen, ggo’s. De inzet is meer mogelijkheden voor lidstaten om, op basis van  nationale voorkeuren en behoeften, de teelt van ggo’s te beperken of te verbieden op hun grondgebied.

Het Europees Parlement moet zich uitspreken over een voorstel dat eind juli in de Raad van Europa werd aangenomen met een grote meerderheid, waarbij België zich onthield. Dat voorstel in een unicum voor de Europese Unie.

Nationale bevoegdheden

In Europa worden teelt-toestemmingen voor ggo’s uitgevaardigd door de Europese instanties, met een belangrijke rol voor het Europees Agentschap voor Voedselveiligheid, dat een uitgebreide wetenschappelijke analyse doet voor elk genetisch gemodificeerd gewas waarvoor een teelt-aanvraag wordt ingediend.

Momenteel is er maar één gewas goedgekeurd voor teelt, M0N 810, een maïssoort die resistent is gemaakt tegen insectenvraat . Deze ggo wordt momenteel geteeld in vijf lidstaten, met Spanje op kop. Negen lidstaten hebben de teelt van MON 810, en bij uitbreiding alle ggo-gewassen, expliciet verboden.

Volgens de bestaande Europese wetgeving hebben lidstaten echter slechts beperkte mogelijkheden om na EU goedkeuring de teelt van ggo’s te bannen. Eens een ggo-gewas de toestemming heeft gekregen van de EU, mag het overal in Europa geteeld worden. Enkel wanneer een lidstaat kan aantonen dat het gewas in kwestie een gevaar vormt voor het milieu of de menselijke gezondheid, en dit kan staven met nieuw wetenschappelijk bewijs dat de eerdere analyses van het Europees Agentschap teniet doet, mag een lidstaat het gewas binnen haar grenzen bannen.

De nieuwe wetgeving die nu in het Europees Parlement op tafel ligt, breidt de mogelijkheden voor lidstaten om beperkende of verbiedende maatregelen tegen ggo’s te installeren aanzienlijk uit. Het wetgevend voorstel is het resultaat van jarenlange oppositie van lidstaten tegen teeltaanvragen voor ggo’s. Toen de Commissie in 2010 het voorstel lanceerde, hoopte ze daarmee de lidstaten over de streep te trekken om teelt-aanvragen goed te keuren, met het vooruitzicht dat ze het goedgekeurde gewas later alsnog zouden kunnen bannen. 

De nieuwe wetgeving geeft lidstaten op twee manieren een ‘opt-out’ mogelijkheid. Ten eerste kunnen lidstaten met het bedrijf dat een aanvraag voor markttoelating doet, overeenkomen om hun grondgebied uit de aanvraag te schrappen. Als het bedrijf daar niet mee akkoord gaat, kan de lidstaat de ggo toch nog bannen op grond van een lijst rechtvaardigingsgronden, zoals ruimtelijke ordening, landgebruik en openbare orde.

Ook redenen gerelateerd aan milieubeleid mogen ingeroepen worden om de teelt van het ggo-gewas te verbieden.

Nieuwe bevoegdheden: unicum

Deze wetswijziging zal een unicum zijn voor de Europese Unie in vele opzichten. Voor het eerst zullen lidstaten de uitdrukkelijke mogelijkheid hebben om de geografische reikwijdte van een Europese markttoelating te bepalen in samenwerking met de aanvragers. Voor het eerst schuift de EU haar lidstaten een bevoegdheid terug, nu lidstaten voortaan zelf kunnen kiezen om welke reden ze een ggo bannen. De nieuwe wetgeving is daarin ook een radicale breuk met de gebruikelijke wetenschappelijke onderbouwing die een lidstaat moet geven wanneer ze wil afwijken van de Europese regels in verband met voedselveiligheid.

De vraag is niet of we meer of minder ggo’s willen. De vraag is hoeveel ruimte lidstaten moeten krijgen, in een Europa dat streng toeziet op de goede werking van zijn gemeenschappelijke markt, waarin Europese voedselstandaarden en grensoverschrijdende procedures cruciaal zijn.

De vraag is ook of een Europese teelt-toestemmingsprocedure verenigbaar is met de voorgestelde nationale uitzonderingsgronden die lidstaten kunnen inroepen zonder wetenschappelijke rechtvaardiging.

Bovendien is het niet uitgesloten dat, als het Europees Parlement het voorstel aanneemt, lidstaten ook op andere terreinen meer beslissingsvrijheid zullen (terug)eisen en het voorstel dus een precedent kan zijn.

Het hoeft niet te verbazen dat bedrijven als Monsanto en Pioneer hun teelt-aanvragen hebben teruggetrokken. Zij laten de vijandige Europese markt voor wat ze is en kiezen(genetische gemodificeerde) eieren voor hun geld door zich te concentreren op de landen buiten Europa waar ggo’s op grote schaal worden geteeld, zoals in de VS, China, Argentinië, Canada, Brazilië., etc.

Het Europees Parlement wacht een belangrijke discussie. Komen ggo’s terecht op het bord van de lidstaten, en hoever mogen ze gaan om ggo’s voortaan te verbieden? We zullen het weldra te weten komen.
