Gedragswetenschappelijk onderzoek binnen de muren: een verkennende studie naar de moeilijkheden die gepaard gaan met een forensische context.

In naam van de wetenschap: op avontuur in de gevangenis

De gedachte aan wetenschappelijk onderzoek met gevangenen roept wellicht beelden op van duistere toestanden, zoals de medische experimenten die plaatsvonden in de concentratiekampen tijdens de Tweede Wereldoorlog. Inderdaad, voornamelijk sinds toen werden gevangenen gezien als de ideale proefpersonen en vanaf de jaren ’50 vonden ook psychologische experimenten met gedetineerden hun opgang. Gelukkig werd er na verloop van tijd meer nagedacht over de ethische implicaties van zulke onderzoeken. Regelgeving werd strikter en de mensonwaardige behandeling van gevangenen werd verbannen.

Forensische gedragswetenschappenDoor het ontstaan van deze strenge ethische codes was onderzoek in de gevangenis een tijdlang eerder beperkt. Het is pas de laatste twee decennia weer op de voorgrond getreden met het idee dat dit soort onderzoek belangrijk is voor het verbeteren van het gevangeniswezen zelf. Geen gruwelijke psychologische experimenten meer om de menselijke geest te analyseren, maar juist studies naar de levenskwaliteit van gevangenen met de bedoeling deze te verbeteren.

Hoewel dit soort onderzoek de focus wordt van steeds meer psychologen en criminologen, is het domein van de forensische gedragswetenschappen niet sterk geworteld in België. Er bestaat bijvoorbeeld geen volwaardige opleiding voor; niet voor onderzoekers, noch in kader van hulpverlening. Ondanks de stijgende verontwaardiging bij de publieke opinie over de wantoestanden binnen ons rechtssysteem – denk maar aan de talrijke berichten in de media over de slechte behandeling van bijvoorbeeld geïnterneerden – lijkt er zowel op beleidsniveau als op academisch vlak een gebrek aan ambitie te bestaan om hier verandering in te brengen.

Gedragswetenschappelijk onderzoek in een forensische contextStel je voor dat jij als jonge onderzoeker voor de start staat van een moedige onderneming binnen de gevangenismuren. Dan moet je natuurlijk eerst en vooral al op de hoogte zijn van hoe onderzoek gevoerd moet worden via de regels van de kunst. Daarenboven is een forensische context, zoals een gevangenis, een heel specifieke situatie waardoor deze ongetwijfeld bijkomende moeilijkheden zal opleveren. Je zal je dus goed moeten voorbereiden. Echter, al de informatie die je daarvoor nodig hebt, zit erg verspreid en is hierdoor moeilijk te vinden. Het is voor onderzoekers dus niet evident om te weten op welke moeilijkheden ze zich moeten voorbereiden. Onderzoekers met al wat ervaring binnen een forensische setting zullen wel op het één en ander voorbereid zijn, maar elk onderzoek is anders. Ook zij kunnen dus nog onvoorziene hindernissen tegenkomen.

De scriptie “Gedragswetenschappelijk onderzoek binnen de muren: een verkennende studie naar de moeilijkheden die gepaard gaan met een forensische context” heeft de ambitie om als uitvalsbasis te kunnen dienen voor onderzoekers. Hiertoe tracht het alle informatie omtrent onderzoek in een forensische context te bundelen die een onderzoeker nodig heeft om van zijn onderneming een succes te maken. Het geeft een uitgebreid overzicht van obstakels die op de weg kunnen liggen van een onderzoeker die in een forensische context een onderzoek aanvat.

Ten eerste lijst de scriptie een aantal bijkomende ethische kwesties op waar een onderzoeker moet over reflecteren vooraleer hij zijn onderzoek kan starten. De specifieke context van een gevangenis roept bijvoorbeeld extra vragen op omtrent de vrijwillige toestemming van de participanten. Ligt er onrechtstreeks geen druk op gevangenen om deel te nemen aan zulk wetenschappelijk onderzoek, juist omdat ze van hun vrijheid beroofd zijn? Ten tweede zijn er ook heel wat praktische moeilijkheden waar een onderzoeker een antwoord op dient te bieden. Zo blijken bijvoorbeeld de procedures om officiële toestemming te krijgen (van de overheid en de instelling zelf) onduidelijk. Ten derde gaat het in een gevangenis om een heel specifieke groep van mensen waarbij het niet ondenkbaar is dat bepaalde persoonskenmerken het vlotte verloop van het onderzoek kunnen verstoren. Op dit vlak worden ook de symptomen besproken van enkele psychiatrische ziektebeelden die regelmatig voorkomen in de gevangenis (zoals bijvoorbeeld schizofrenie en een cluster B persoonlijkheidsstoornis). Ten slotte wordt ook de vraag gesteld of gevangenen misschien vatbaarder zijn voor sociale wenselijkheid (d.i. het beantwoorden van vragen op een manier die overeenstemt met wat sociaal aanvaardbaar is) en of non-respons (d.i. een weigerachtigheid om deel te nemen) een groter probleem vormt in een forensische context.

Naar een institutionalisering van de forensische gedragswetenschappen?De scriptie Gedragswetenschappelijk onderzoek binnen de muren is tot stand gekomen dankzij de medewerking van een aantal Vlaamse onderzoekers. Het is opmerkelijk dat voornamelijk jonge onderzoekers, die in veel gevallen zelf nog hun eerste echte onderzoek moesten afronden, geïnteresseerd waren om zich te laten interviewen. Bij hen zaten de moeilijkheden die ze ondervonden als gevolg van de forensische context waarschijnlijk nog fris in het geheugen. Daarenboven wijst dit er misschien ook op dat er nood is aan een meer structurele aanpak van de opleiding van forensische gedragswetenschappers.
