(On)recht in Zuid-Kivu: de uitdagingen voor een op kinderrechten gebaseerd reïntegratiebeleid
Vijftien jaar oud en trillend van adrenaline richt hij zijn Kalasjnikov op de laatst overgebleven tegenstanders. Zijn oren suizen nog na van de granaatinslag waarvoor hij net dekking had gevonden. Bijna heeft hij de overwinning bereikt. Het geweer ratelt in zijn handen en een na een stuiken zijn vijanden in elkaar totdat een schelle klik weerklinkt. Pijlsnel dringt het tot hem door dat hij geen munitie meer heeft. In zijn ooghoek ziet hij nog net twee gewapende mannen opdoemen, maar het is te laat. Vijf kogels doorboren hem in een mum van tijd. Game over. Hij schenkt zichzelf een bruisende, ijskoude cola in en zet de televisie uit. Volgende keer beter, sust hij zich.
In Oost-Congo is gewapend conflict voor kinderen en jeugd geen vrijblijvende ontspanning, maar bittere ernst. Naar schatting 35 000 minderjarigen leven er met een verleden als kindsoldaat. Nog eens 5000 zijn het vandaag. Terug in het Westen is er grote verontwaardiging over het lot van deze kinderen. Van Belgische scholen tot in de Veiligheidsraad zijn er talloze initiatieven genomen om dit onrecht aan te klagen en de situatie van deze onfortuinlijke kinderen te verbeteren. Tientallen hulporganisaties snelden ter plekke om hen te helpen te bouwen aan een nieuwe toekomst ver weg van gewapende groeperingen.
De vraag die zich stelt is of hun programma's wel het verhoopte resultaat hebben en de kinderen aan een nieuw en beter leven helpen. Om hier achter te komen, moeten we eerst een duik nemen in de leefwereld van die duizenden kindsoldaten. Hoe komen ze in zo'n gewapende groepering terecht?
Kindsoldaten zijn alle minderjarigen die op een of andere manier werken voor het leger of een gewapende groep. Zeer vele onder hen zijn onder dwang gerekruteerd, maar merkwaardig genoeg zegt meer dan de helft van de kindsoldaten in Zuid-Kivu vrijwillig de wapens te hebben opgenomen.
Dat kinderen zich vrijwillig in zo'n gevaarlijke situatie storten is voor ons onvoorstelbaar. Maar tegelijkertijd zijn een hele hoop zaken die wij hier zo vanzelfsprekend vinden even onvoorstelbaar voor kinderen in Zuid-Kivu. Meer dan 40 procent onder hen heeft nooit school gelopen. Bovendien wordt het platteland geteisterd door een nijpend voedseltekort veroorzaakt door de jarenlange plunderingen en snelle bevolkingsaangroei. Jongeren in de stad zijn niet veel beter af. Zij slagen erin gemiddeld slechts een schamele vijftien dollar per maand bijeen te sprokkelen. Een hele generatie heeft er dus amper vooruitzicht op degelijk werk en een volwaardige rol in de maatschappij. Zo kan bij een gewapende groepering gaan een strategie worden om jezelf van eten te voorzien en gewapenderhand respect af te dwingen.
Hulporganisaties kaderen de hele problematiek binnen de kinderrechten. Het Kinderrechtenverdrag verbiedt niet enkel het rekruteren van kinderen. Volgens dit verdrag hebben kinderen ook recht op essentiële zaken als onderwijs, een gepaste levensstandaard en ouderlijke bescherming. De schending van deze rechten ligt volgens de organisaties aan de basis van het fenomeen van de kindsoldaten. Daarom richten de hulpverleners hun programma's op het realiseren van deze rechten door scholing of specifieke beroepstraining te voorzien. Na een kort verblijf in een opvangcentrum worden de jongeren opgeleid tot metser, schrijnwerker of naaister. De idee hierachter is dat ze zichzelf zo van een inkomen voorzien en een toekomstbeeld uitbouwen.
Deze op kinderrechten gebaseerde aanpak is een enorme sprong vooruit in vergelijking met vroegere programma's, waar kindsoldaten met enkel wat zakgeld of een deken meteen naar huis werden gestuurd. Toch worden de programma's nog met grote uitdagingen en tekortkomingen geconfronteerd. Hulpverleners tonen zich gefrustreerd omdat het merendeel van de kindsoldaten naar de steden vertrekt en er op straat belandt. Vele anderen zoeken terug aansluiting bij een gewapende groep of gaan in door rebellen gecontroleerde mijnen werken. Bovendien blijft een hele grote groep hardnekkig kampen met psychische stress en trauma's.
Een deel van de verklaring voor deze problemen vinden we in de wanhopig slechte economische situatie in Oost-Congo. De dorpen in het platteland hebben niet eens voldoende geld om zich elke dag van eten te voorzien. Laat staan dat ze nieuwe kleren of een tafel zouden kunnen kopen van een ex-kindsoldaat die zich net heeft omgeschoold tot naaister of schrijnwerker. De jobs die de jongeren leren zijn dus niet aangepast aan de economische realiteit. Toch is er nog meer aan de hand waar de hulporganisaties geen blijf mee weten.
Nyangezi is een klein, gezellig dorpje in Zuid-Kivu. Toen we erdoor wandelden, werden we al gauw benaderd door goedlachse vrouwen in kleurrijke panjekleren. Enkelen onder hen bleken familie te zijn van Dieudonné en Furaha. Ze vertelden hoe deze kinderen zich na als kindsoldaat bij de mayi-mayi rebellen te zijn geweest, bezeten voelden door geesten. Het reïntegratieprogramma dat ze hadden doorlopen hielp niet. Gelukkig, zo zeiden ze, wist de katholieke exorcist hen te genezen. Dit is geen toeval. Mayi-mayi strijders peppen zich op voor de strijd door fetishen te gebruiken en geesten op te roepen die hen onoverwinnelijk zouden maken. Eenmaal de kinderen uit de groepering gaan, vinden zij en hun familie in deze praktijken een gemakkelijke verklaring voor hun psychologische problemen. Verder onderzoek en gesprekken met priesters toonden aan dat deze twee slechts voorbeelden waren van de talloze kinderen die door dezelfde verschrikkelijke ervaring gaan. Hun getuigenissen stonden in schril contrast met de verklaringen van de hulpverleners, die geen van allen al hadden gehoord van dit fenomeen.
Een ander zeer vaak terugkerend psychisch probleem is hoe de ex-kindsoldaten verteerd worden door schuldgevoelens. Eenmaal ze na vaak lange tijd uit de gewapende groep komen, herontdekken ze dat plunderen en moorden moreel verkeerd is. Al te vaak blijkt echter hoe hun nood om hierover te praten in dovemansoren valt bij de hulpverleners. Meestal proberen ze de kinderen ervan te overtuigen dat ze zich niets te verwijten hebben, omdat ze slachtoffers waren van de situatie. Dit komt echter niet overeen met de ervaring van de kindsoldaten die de indruk hebben vrijwillig te hebben gehandeld.
De hulporganisaties blijken zich dus al te vaak blind te staren op de oorzaken van het fenomeen, het gebrek aan onderwijs en inkomen, en de ingrijpende gevolgen van een gewelddadig verblijf bij gewapende groeperingen over het hoofd te zien. Dit verwarren van oorzaken met gevolgen zorgt ervoor dat de programma's zo begaan zijn met algemene kinderrechten dat ze de specifieke noden van kindsoldaten uit het oog verliezen. Bijna alle kinderen in Zuid-Kivu hebben nood aan scholing en levensonderhoud. Om kindsoldaten daarentegen werkelijk aan hun toekomst te laten bouwen, moeten de programma's zich er dringend meer op richten hen te helpen hun pijnlijke verleden achter zich te laten. Met alle geesten en misdaden die daarbij horen.
