Meisjes onder bevel: een mensenrechtelijke studie over vrouwelijke kindsoldaten

Internationale gemeenschap vergeet vrouwelijke kindsoldaten

Woorden schieten te kort voor de gruwel die ongeveer 250 000 kindsoldaten anno 2014 dagelijks meemaken. Uit recent onderzoek is daarenboven gebleken dat ongeveer 120 000 van deze kinderen meisjes zijn die een verscheidenheid van taken uitoefenen, waaronder ook het meevechten aan de frontlinie. Deze kwetsbare groep wordt echter door het merendeel van de internationale regelgeving uit het oog verloren en krijgt daardoor niet de bescherming die ze verdient.

Het inzetten van kindsoldaten is een verontrustend sociaal en politiek fenomeen en is even oud als de praktijk van oorlogvoering zelf. Over de hele wereld werden en worden dagelijks kinderen ingezet om strijd te voeren voor volwassenen. Wanneer men het woord ‘kindsoldaten’ hoort, wordt echter nog steeds het beeld opgeroepen van kleine jongens met geweren in de aanslag. Heel zelden denkt men aan de rol die meisjes spelen in diezelfde gewapende conflicten terwijl werd aangetoond dat bijna de helft van de actieve kindsoldaten meisjes zijn. Maken de internationale beleidsmakers diezelfde fout en zien ze bijgevolg vrouwelijke kindsoldaten over het hoofd? Laurence Lambert wijdde er haar masterscriptie aan.

Meisjes in de kou
Uit het onderzoek is inderdaad gebleken dat ook de internationale gemeenschap vrouwelijke kindsoldaten uit het oog verliest. Dit gebeurt voornamelijk in de internationale regelgeving. De belangrijkste internationale wetgevende instrumenten focussen zich immers op de stereotiepe mannelijke taken die kinderen vervullen in gewapende conflicten. Enkel typische jongenstaken worden verboden en veroordeeld. Hierdoor wordt de realiteit waarin meisjes zich bevinden niet in al haar aspecten aangepakt en vallen vrouwelijke kindsoldaten buiten de bescherming van een groot deel van de bestaande verdragen.

Niet enkel de regelgeving maar ook de reeds bestaande re-integratieprogramma’s schieten ruimschoots te kort en laten meisjes al te vaak in de kou staan. Voor deze programma’s is het ontwapenen en re-integreren van jongens – al dan niet onbewust – prioriteit en vrouwelijke kindsoldaten worden bijgevolg aan hun lot over gelaten. Hier houdt het voor hen echter niet op. Wanneer de meisjes terugkeren naar hun gemeenschap, dit meestal zonder re-integratiehulp, zijn ze in het merendeel van de gevallen het slachtoffer van verstoting en staan ze er de rest van hun leven helemaal alleen voor.

En de internationale rechtspraak? Ook deze laat hier en daar wat steken vallen. Er worden telkens stappen in de goede richting gezet maar een echt bevredigend resultaat is er tot nu toe nog steeds niet.

Licht aan het einde van de tunnel?
Deprimerend lijkt het allemaal maar men mag de hoop niet opgeven. Een grote rol ligt weggelegd voor onder andere de media . Door niet enkel reportages te maken over mannelijke kindsoldaten maar ook meisjes de nodige aandacht te geven, zullen meer en meer mensen zich van de werkelijke situatie bewust worden. Ook geloofsleiders kunnen hun steentje bijdragen en de rebellenleiders – die vaak heel gelovig zijn – tot de orde roepen. Dit en nog meer mogelijke, voornamelijk regelgevende, oplossingen worden aangereikt in het onderzoek.

Een positieve beweging werd reeds ingezet. Meer en meer onderzoek wordt gedaan naar de specifieke situatie van vrouwelijke kindsoldaten en ook in de internationale rechtspraak worden zaken als seksslavernij en gedwongen huwelijk aangepakt, zaken waarvan voornamelijk meisjes in gewapende conflicten het slachtoffer zijn. De internationale gemeenschap ziet in dat ook meisjes gruwelijke en mensonterende taken dienen te vervullen in gewapende conflicten en dat ook zij bijgevolg een gelijkwaardige bescherming en begeleiding nodig hebben. Daarenboven kunnen staten, dankzij de rapporten van verschillende ngo’s, een beleid aannemen dat alle facetten van het leven van kindsoldaten dekt en tegemoet komt aan de beschermingsnoden van zowel mannelijke als vrouwelijke kindsoldaten.

Heel veel stappen in de goede richting werden dus reeds genomen maar we mogen niet op onze lauweren rusten. De internationale gemeenschap laat nog al te vaak steken vallen. De strijd is nog niet gestreden.
