Het rechtsbegrip bij Hart: meer dan 50 jaar later
Deze masterproef neemt "The Concept of Law" van H.L.A. Hart onder de loep. Al dateert dit boek van 1961, het blijft intellectueel buitengewoon interessant en nuttig voor actuele debatten om het rechtsbegrip van Hart in zijn vele facetten te analyseren.
Harts rechtsbegrip dient onder de noemer van het wetspositivisme geplaatst te worden. Dit positivisme wordt in deze masterproef eerst historisch gesitueerd door een bespreking van de verschillende invloeden erop en de evolutie van de stroming. Het recht bestaat voor Hart fundamenteel uit sociale regels. De kern van een ontwikkeld rechtssysteem bestaat uit het samenspel tussen primaire en secundaire regels. Primaire regels zijn regels die vaak overeenkomen met morele regels en een bepaalde verplichting of verbod opleggen. Deze regels volstaan echter niet. De secundaire regels komen tegemoet aan de tekortkomingen van een prejuridische wereld, waar alleen primaire regels de samenleving beheersen. Deze zijn volgens Hart de rule of adjudication, rules of change en de rules of recognition. Die laatste soort regels wordt verenigd in de ultimate rule of recognition, die het sluitstuk vormt van Harts rechtssysteem. Het rechtssysteem bestaat pas effectief als de primaire regels algemeen gehoorzaamd worden door de burgers en de secundaire regels aanvaard worden door de functionarissen. Een belangrijk en kenmerkend aspect van Harts gematigde positivisme is dat hij recht en moraal scheidt, maar tegelijk toch de deur toch op een kier laat staan voor een minimale morele inhoud van het recht.
Harts bijdrage tot de rechtstheorie is groot, maar niet onomstreden. Deze masterproef zal dan ook trachten de controversiële aspecten en de pijnpunten van Harts rechtssysteem bloot te leggen. Zo kan de analyse ook actuele juridische debatten bevruchten.
