Making the cut
Genitale aanpassingen, al van gehoord?
Iedereen lijkt een mening te hebben wanneer het gaat over genitale aanpassingen, maar we opteren in deze discussies bijna altijd voor de termen ‘besnijdenis’ en ‘genitale verminking’. We denken dat deze praktijk bij de vrouw steeds gelijk staat aan het wegsnijden van de schaamlippen en bij de man slechts een minimale ingreep omvat. Ook opvallend is dat we denken dat deze praktijken alleen in niet-westerse landen voorkomen.
Klopt dit eigenlijk wel?
Om een negatieve/positieve ondertoon (of gevoelswaarde) te vermijden, heb ik in mijn scriptie gekozen voor neutrale termen, namelijk ‘vrouwelijke genitale aanpassing (VGA)’ en ‘mannelijke genitale aanpassing (MGA)’.
Ook in het Westen kennen we genitale aanpassingen: in mijn onderzoek heb ik het specifiek over genitale plastische chirurgie, operaties waarbij het vrouwelijke geslachtsorgaan wordt ‘bijgewerkt’, geperfectionaliseerd als het ware en interseksuele genitale aanpassingen (IGA) . Interseksualiteit is een medische aandoening waarbij een patiënt zowel mannelijke als vrouwelijke genitale geslachtskenmerken heeft.
In mijn scriptie kwam ik tot de conclusie dat er grote gelijkenissen zijn tussen deze praktijken:
Als we VGA en MGA medisch met elkaar vergelijken, komen we tot de vaststelling dat zowel VGA als MGA paraplutermen zijn die verschillende types van aanpassingen omvatten, gaande van ‘licht ingrijpende’ tot ‘zwaar beschadigende’ fysieke ingrepen met zware mentale gevolgen.
Bij IGA krijgt de patiënt, weliswaar na het uitvoeren van uitgebreide medische onderzoeken, een geslacht toegewezen. Deze operatie is vaak niet dringend of noodzakelijk om te functioneren, en brengt op latere leeftijd vaak mentale gevolgen met zich mee.
Zowel bij VGA, MGA, IGA als bij genitale plastische chirurgie wordt gesneden in een normaal functionerend orgaan. Bovendien zijn ze alle ingegeven door culturele of religieuze redenen met als inzet het behoren tot een gemeenschap. Bij VGA, MGA en IGA is er geen toestemming van het kind in kwestie.
Natuurlijk bestaan er ook verschillen tussen de praktijken. Zo wordt IGA steeds in een steriele omgeving en onder verdoving uitgevoerd, in tegenstelling tot VGA en MGA.
Worden er enkel bij VGA mensenrechten geschonden ?
Ondanks de medische gelijkenissen worden deze praktijken juridisch op een verschillende wijze aangepakt. Zo veroordeelt de Wereldgezondheidsorganisatie, een toonaangevende internationale instelling, enkel VGA. Zij verbiedt "ingrepen die leiden tot een gedeeltelijke of volledige verwijdering van de externe geslachtsdelen van de vrouw en/of andere verwondingen van de vrouwelijke geslachtsdelen voor niet-medische doeleinden”.
Wanneer deze definitie letterlijk gelezen wordt, valt ook westerse genitale plastische chirurgie hieronder. Toch is genitale plastische chirurgie in de praktijk niet verboden. Het grote verschil met VGA is dan ook de leeftijd waarop deze praktijk wordt uitgevoerd: bij genitale plastische chirurgie gaat het altijd om een volwassen vrouw. Bij VGA, MGA en IGA beslissen de ouders voor het kind. Waar het recht op zelfbeschikking (het recht dat je toestaat je eigen keuzes te maken) bij genitale plastische chirurgie dus voorop staat, wordt dit recht bij de andere praktijken zwaar geschonden.
Gelukkig lijken zowel nationale overheden als internationale organisaties steeds meer te luisteren naar slachtoffers van MGA en IGA. Het idee dat ouders niet zomaar mogen beslissen over de fysieke integriteit van hun kind, wint dan ook aan belang. Kinderen zouden niet geschaad mogen worden door de culturele of religieuze overtuiging van hun ouders maar zelf drager moeten zijn van hun eigen rechten.
Hoe dit zich in de praktijk dient te vertalen is echter niet eenvoudig. Een grove schending van mensenrechten betekent niet dat zware straffen helpen. Zo wordt VGA in België hard aangepakt, maar lijkt dit het aantal gevallen niet te verminderen. Vaak kan het verbod ook gemakkelijk omzeild worden door VGA toe te passen op de jonge meisjes wanneer deze op vakantie in hun thuisland zijn. Bij eerdere pogingen tot strafbaarstellingen van MGA in Duitsland brak hevig protest uit bij joodse en moslimgemeenschappen.
Toelaten of verbieden?
Ouders willen steeds het beste voor hun kinderen. VGA, maar ook MGA of IGA is een noodzakelijke ingreep in hun gemeenschap. Vaak is het kiezen tussen het ondergaan van de ingreep of volledige uitsluiting uit de gemeenschap.
Zeker is dat het debat best wordt verbreed tot alle genitale aanpassingen. We kunnen niet de ene praktijk veroordelen en de andere, gelijkaardige, gedogen. Dan verliezen we alle geloofwaardigheid. Een erkenning van de vergelijkbaarheid van VGA/MGA/IGA door de Wereldgezondheidsorganisatie lijkt noodzakelijk. Deze erkenning kan versneld worden wanneer niet alleen internationale organisaties maar ook internationale en Europese gerechtshoven zich over deze kwestie durven uit te spreken.
De beste oplossing ligt er in om het kind zelf op latere leeftijd te laten beslissen of het de ingreep wil ondergaan of niet. Om dit mogelijk te maken is het belangrijk om respect te tonen, informatie en onderwijs aan te bieden en alternatieve rituelen op jonge leeftijd voor te stellen.
Eind goed, al goed?
Keuze op latere leeftijd is een win-win situatie. De jongvolwassene kiest bewust voor de ingreep en laat zich daarbij volledig opnemen in de gemeenschap. Natuurlijk zal het kind ook op latere leeftijd onder druk staan van de gemeenschap waarin het opgroeit. Daarom zijn onderwijs, goed beleid en verder onderzoek zo belangrijk. Alleen als op al deze aspecten wordt ingezet, kan op lange termijn zowel de jongere, maar ook de gemeenschap écht winnen. Geen enkele gemeenschap zou het mogen goedkeuren dat een genitale aanpassing ondoordacht wordt toegepast, ongeacht of dit nu door een arts of een andere persoon wordt uitgevoerd.
