Nooit meer “Wir haben es nicht gewußt”

Nooit meer, klonk het doorheen Duitsland en de rest van Europa, toen de gruwelijkheden die de joden hebben ondergaan aan het licht kwamen. De mengeling van verbijstering en schaamte illustreerde voortreffelijk hoe passiviteit actief kwaad in de hand kan werken. Nooit meer, waarom weten we dan nu van niks? De schaal en wijze waarop de Holocaust zich voltrok staat feitelijk gezien dan wel veraf van de huidige gebeurtenissen, het collectieve wegkijken is daarom niet anders.

We nemen maar al te graag deel aan het publieke debat over onze verantwoordelijkheden ten opzichte van vluchtelingen, maar weten tegelijkertijd niks over de gevolgen van onze acties in Syrië en Irak voor de burgers daar, die vaak door ons toedoen diezelfde aanspoelende vluchtelingen worden. Die desinteresse is misplaatst, we dragen immers een collectieve verantwoordelijkheid voor de acties van ons leger -zo werkt onze geliefde democratie nu eenmaal.  

Slachtoffers zonder dader

De Internationale Coalitie tegen IS, waar België deel van uitmaakt, ligt reeds geruime tijd onder vuur voor haar gebrek aan transparantie over burgerslachtoffers. Terwijl de coalitie onder de druk van ngo’s ondertussen zo’n duizend burgerslachtoffers heeft erkend, schat Airwars, een neutrale denktank, dat het werkelijke aantal zo’n zes à tien keer hoger ligt.

Bizar genoeg heeft behalve de V.S. geen enkel lid van de coalitie toegegeven burgerslachtoffers gemaakt te hebben. Ook België beweert dus, na honderden luchtaanvallen, geen enkel burgerslachtoffer gemaakt te hebben, ondanks concrete beschuldigingen van ngo’s.

Geen controle op leger

De reden waarom de cijfers van het Belgisch leger en ngo’s zo sterk uit elkaar liggen, is omdat de huidige juridische positie van het leger er één van quasi absolute vrijheid is. Dit is niet enkel problematisch voor de huidige oorlog met de coalitie, maar voor eender welke operatie in de toekomst.

Er zijn twee manieren waarop men een check op het leger kan organiseren. Ofwel kan men het overlaten aan een parlementaire commissie, ofwel kunnen ngo’s via de openbaarheid van bestuur vragen om gegevens over de luchtaanvallen. Vervolgens toetsen ngo’s die gegevens, zoals de plaats, het aantal en de datum van luchtaanvallen, aan andere informatie (bv. veldrapporten) die zou wijzen op burgerslachtoffers.

Beide wijzen leiden tot ondermaatse resultaten en het is zeer waarschijnlijk dat het huidig juridisch systeem om informatie op te vragen bij het leger de rechtspraak van het Europees Hof voor de Rechten van de Mens (EHRM) schendt.

Passiviteit Parlement

 Defensie benadrukt graag dat we een parlementaire democratie zijn en dat het aan onze volksvertegenwoordigers en niet ngo’s is om het leger te controleren. Echter, die volksvertegenwoordigers hebben hiertoe bitter weinig middelen.

In tegenstelling tot zowat elke westerse democratie en ondanks voorstellen van zowat elke partij om dit te veranderen, kan het leger nog steeds zonder de toestemming van het parlement ten oorlog trekken en kunnen volksvertegenwoordigers niet veel meer doen dan informatie vragen. Ook het opvragen van informatie in een gesloten commissie stelt weinig voor volgens rapporten van Vredesactie. Eén uurtje per maand bespreken ze de details van een 8-tal legermissies terwijl het verboden is notities te nemen, wat een werkelijke controle onmogelijk maakt.

Intransparantie is een mensenrechtenschending

Het Ministerie van Defensie verhindert bovendien de tweede optie, een publieke controle door ngo’s, door alle data te classificeren. Het juridisch kader dat deze praktijk overheerst, schendt hoogstwaarschijnlijk -het is nog niet tot een zaak gekomen- de rechtspraak van het EHRM.

Het Hof erkende eind 2016 dat publieke waakhonden, zoals journalisten en ngo’s, een recht hebben op informatie van de overheid. Dit recht is relatief en de overheid kan dit bijvoorbeeld weigeren omwille van de nationale veiligheid. Indien het in dit geval ooit tot een rechtszaak zou komen, zou het dus om de feitenkwestie draaien of het delen van gegevens over de luchtaanvallen de nationale veiligheid kan schenden.

Ongeacht hun beoordeling in deze zaak, is het echter duidelijk dat het juridisch systeem dat het leger momenteel toelaat niets vrij te geven, van killer-lists tot wapenaankopen, de rechtspraak van het Hof schendt.

Administratie eigen rechter bij classificatie

In het Belgisch systeem heeft het leger twee mogelijkheden. Ofwel kan het gegevens classificeren, wat het met alle gegevens over de oorlog het gedaan, ofwel doet het dit niet en kunnen burgers ze opvragen via de openbaarheid van bestuur.

Bij classificatie kunnen enkel gemachtigde personen weer declassificeren. Dit betekent dat het onmogelijk is een rechter te vragen gegevens te declassificeren omdat ze geclassificeerd zouden zijn zonder dat daar een wettelijke reden voor bestaat. Met andere woorden, het Ministerie van Defensie kan alles classificeren wat ze wil, zonder dat iemand kan nagaan of dat geen gegevens zijn waarvan het belangrijk is dat er –zonder gevaar voor de staat uiteraard- een publiek debat ontstaat.

Als de gegevens niet geclassificeerd zouden zijn, kunnen burgers het aanvechten bij een rechter wanneer het ministerie weigert ze vrij te geven, maar die rechter kan niet meer doen dan zeggen dat de beslissing van het ministerie fout was. Dit betekent dat burgers vervolgens gewoon opnieuw om de documenten moeten gaan vragen, waarop het ministerie een nieuwe reden kan inroepen om ze niet vrij te geven en die rechter nooit zelf kan bevelen de documenten te geven.

Dergelijke praktijken, waarbij de administratie alle macht heeft zonder dat er een juridische controle is, tolereert het Hof uiteraard niet. In eerdere rechtspraak heeft het al meermaals aangegeven dat het weigeren van documenten vrij te geven op zich geen probleem vormt, maar dat er wel een onafhankelijke rechter moet kunnen oordelen of dit gerechtvaardigd is. Bovendien kan via haar klokkenluiderstest geargumenteerd worden dat er altijd een afweging gemaakt dient te worden tussen het publiek belang en het staatsbelang, in plaats van zoals nu meteen een classificatie of een weigering tot vrijgave toe te laten zodra er een wettelijke grond bestaat.

Onder de zonet genoemde omstandigheden klinkt nooit meer “wir haben es nicht gewußt” nogal loos. We weten niks over Belgische burgerslachtoffers en zelfs als we het zouden willen weten hebben we een waterdicht systeem opgezet dat dat verhindert. Willen we toekomstige catastrofes vermijden, moeten wij burgers ons nu laten horen voor wettelijke verandering. We weten tenslotte genoeg.
