Robotic-Assisted Surgery: Key Aspects on Liability in the EU and the US

DE AANSPRAKELIJKHEID VAN DOKTER ROBOT

In een periode van ongeveer 30 jaar verzekerden chirurgische robots zich van een prominente plaats in het operatiekwartier, hetgeen ze te danken hebben aan de belofte van grotere precisie, kwaliteitsvollere operaties en kostenbesparende eigenschappen. De druk die deze evolutie kan uitoefenen op de gevestigde aansprakelijkheidsregimes komt echter veel minder in het licht te staan. Met andere woorden, wat zijn de gevolgen als dokter Robot een medische fout begaat?

Help! Mijn dokter is een robot

De chirurgische robots worden momenteel nog steeds bestuurd of aangestuurd door een chirurg. Hun taak bestaat erin deze laatste te assisteren en (vooralsnog) niet om ze te vervangen. De PUMA 560, de allereerste chirurgische robot (1985), bijvoorbeeld elimineerde de tremor in de hand van de chirurg. Desalniettemin vertonen deze robots een zekere mate van autonomie via hun programmering. De robot voert namelijk een bepaalde handeling of berekening uit aan de hand van de gegeven input. Wanneer er echter iets misloopt in de uitvoering van haar programmering, kunnen de gevolgen voor de patiënt een dramatische omvang aannemen.

De postoperatieve oplossingen…

Dit onderzoek verdiept zich niet in de technische preventiemaatregelen, maar analyseert de postoperatieve aansprakelijkheidsopties van de patiënt binnen de Europese Unie en de Verenigde Staten van Amerika. De vergelijking van beiden illustreert het bestaan van een two-track systeem in zowel de Europese als Amerikaanse aansprakelijkheidsregels. De patiënt heeft namelijk de mogelijkheid compensatie te bekomen via productaansprakelijkheid of medische aansprakelijkheid, waarbij de onderliggende fout respectievelijk bestaat in hoofde van de producent van de robot of de opererende arts.

Hoewel de hierboven vernoemde aansprakelijkheidsopties een vrij breed toepassingsgebied kennen, dreigt chirurgische robotica hierbuiten te vallen. De klassieke aansprakelijkheidsregels leggen het gros van de bewijslast bij de patiënt, terwijl net deze zich vaak in een minder sterke positie bevindt. Ten eerste valt het oorzakelijk verband tussen de fout en de schade vaak moeilijk te bewijzen. Robots vertonen immers een zeer complexe interactie van talloze elementen, dewelke allemaal vatbaar zijn voor externe factoren (software, hardware, elektriciteit, netwerkverbinding, …). Ten tweede valt de juridische definitie van een gebrek steeds moeilijker te rijmen met de complexiteit van deze robots, waardoor het aantonen van een gebrek in een robot op zich al een ware opgave wordt. Ten laatste bestaan er ook nog enkele wettelijke uitzonderingen die de producent van hoogtechnologische producten, zoals chirurgische robots, vrijwaren en de patiënt volledig in de kou laten staan.

Richting nieuwe oplossingen

Deze problemen van het traditionele two-track system leggen druk op de toegankelijke verhaalsmogelijkheden voor patiënten. Daarnaast zal de autonomie van robots in de toekomst enkel maar toenemen, wat vragen oproept rond de aansprakelijkheid van robots zelf. De tijd is aangebroken voor de wetgevers om de huidige aansprakelijkheidsregimes te evalueren en te garanderen dat patiënten over voldoende toegankelijke verhaalsmogelijkheden beschikken, zowel in het nu als in de toekomst. Ook hier geldt het motto “beter voorkomen dan genezen”.
