De Klimaatcrisis voor de Rechter: Doorbraken in Wetenschap en Rechtspraak

De gevolgen van de opwarmende aarde worden steeds tastbaarder en treffen steeds grotere groepen mensen. In toenemende mate worden bedrijven en overheden aangeklaagd voor hun rol in de klimaatverandering. Deze rechtszaken, ook bekend als ‘klimaatzaken’, hebben tot doel bedrijven en overheden aansprakelijk te stellen voor hun bijdrage aan de klimaatcrisis en ze te laten veroordelen om hun uitstoot te verminderen of schadevergoedingen te betalen. Doorbraken in de klimaatwetenschap en nieuwe juridische redeneringen zorgen ervoor dat de kans groeit dat de grote uitstoters van broeikasgassen (uit)eindelijk aansprakelijk gesteld zullen worden voor de schade die ze veroorzaken.

Klimaatverandering verwoest levens

Klimaatverandering is een van de grootste uitdagingen waarmee de mensheid ooit te maken had.. De gevolgen ervan zijn al voelbaar, en ze zullen alleen maar erger worden als we niets doen. Deze gevolgen zijn niet alleen beperkt tot het milieu. Klimaatverandering heeft ook een verwoestende impact op mensenlevens. Natuurrampen, zoals overstromingen, droogtes en bosbranden, veroorzaken elk jaar miljoenen slachtoffers.

In lijn daarmee neemt het aantal klimaatgerelateerde rechtszaken snel toe. De uitkomst van veel van die rechtszaken is afhankelijk van het aantonen van een causaal verband. De feitenconstellaties in klimaatrechtszaken zetten de in de rechtszaal algemeen toegepaste causaliteitstests vaak onder druk. Dit komt doordat klimaatverandering een complex fenomeen is dat wordt beïnvloed door vele factoren, zoals natuurlijke variabiliteit.Hoeveel schade een weerfenomeen veroorzaakt wordt dan weer mede beïnvloed door vooraf bestaande kwetsbaarheden (zoals de slecht onderhouden dammen in Derna in Libië, die bijdroeg aan de omvang van de ramp).  Dit maakt het moeilijk om een causaal verband aan te tonen tussen de uitstoot van broeikasgassen door individuele uitstoters en de klimaatschade die wordt geleden door individuele eisers.

Onrecht, geen pech

Natuurrampen veroorzaakt door klimaatverandering zijn geen ongevallen. Ze zijn het gevolg van de activiteiten van bedrijven en overheden die fossiele brandstoffen verbranden en daarmee de uitstoot van broeikasgassen verhogen. In mijn masterproef heb ik onderzocht hoe een aantal evoluties het mogelijk maken om wetenschappelijk bewijs van het causale verband tussen antropogene oorzaken van klimaatverandering, de klimaatverandering zelf en de gevolgen van klimaatverandering te vertalen naar juridisch bewijs van causaliteit.

De doorbraken situeren zich op verschillende gebieden. Aan de wetenschappelijke kant worden de bijdragen van individuele bedrijven en landen aan de totale hoeveelheid broeikasgassen in de atmosfeer nauwkeurig in kaart gebracht. Tegelijk kan via zogenaamde attributiesstudies (zie bv. https://www.worldweatherattribution.org/) snel en nauwkeurig becijferd worden in welke mate bepaalde weerfenomenen veroorzaakt zijn door de klimaatverandering. Zo kon bijvoorbeeld berekend worden dat de regenval die de stad Derna in Libië verwoest heeft, 50 keer waarschijnlijker en tot de helft intenser was in het huidige klimaat dan ze geweest zou zijn in een klimaat zonder door de mens veroorzaakte broeikaseffect. 

Ook op juridisch vlak beweegt er veel. Het gaat om beter wetenschappelijk bewijs,  baanbrekende rechterlijke uitspraken, zoals die in de klimaatzaak Urgenda en de zaak Shell in Nederland, en om nieuwe juridische redeneringen en theoretische kaders. In mijn thesis is dat duidelijk gebleken uit de case studies, waarin ik recente klimaatzaken vergelijk met zaken van langer geleden. 

Fossiele vervuilers voor de rechter

Verwoeste huizen op Puerto Rico na de doortocht van orkaan Maria

In de recente aanklacht tegen ExxonMobil en andere fossiele brandstofbedrijven van een aantal gemeentebesturen in Puerto Rico, is het wetenschappelijk bewijs veel sterker dan in de eerste golf Amerikaanse klimaatzaken uit de jaren ‘00 en ‘10. De gemeenten tonen overtuigend aan dat de schade die ze geleden hebben door de orkaan Maria in 2017 veel kleiner geweest zou zijn, mocht het klimaat niet al zo veel warmer geworden zijn door de uitstoot van de fossiele bedrijven. 

Bovendien kwam aan het licht dat bedrijven zoals ExxonMobil, ondanks het feit dat hun interne studies al sinds decennia waarschuwen voor het gevaar van klimaatverandering, toch zwaar bleven lobbyen om emissiereducties tegen te houden. Advocate Melissa Sims en haar collega’s konden ze zo samen met andere bedrijven uit de sector aanklagen als ‘criminal enterprise’ onder de RICO-wetgeving, die oorspronkelijk aangenomen werd in de strijd tegen de maffia in de VS. 

Inspiratie kan ook komen uit de uitwisseling tussen jurisdicties: de redeneringen die in de klimaatzaken in Nederland gevolgd werden, inspireerden bijvoorbeeld ook de Belgische klimaatzaak. Ook uit historische processen over aansprakelijkheid voor gezondheidsschade en vervuiling (zoals asbest of DES) kunnen redeneringen gehaald worden die naar analogie toegepast worden in klimaatzaken. 

De smoking gun gevonden?

Ik heb vastgesteld dat de klimaatwetenschap in staat is om met opmerkelijk hoge betrouwbaarheid causale verbanden aan te tonen tussen de uitstoot van broeikasgassen, klimaatverandering, en de schade die er het gevolg van is. Klimaatwetenschap levert bewijs met een waarschijnlijkheid die hoog genoeg is om te voldoen aan de bewijsstandaard die geldt in burgerlijke rechtszaken en dat voldoet aan de ontvankelijkheids- en betrouwbaarheidsnormen voor gebruik in de rechtbank. 

Hoewel het bewijzen van een oorzakelijk verband tussen lokale klimaatimpacts en individuele uitstoters van broeikasgassen een uitdaging blijft, kan ook deze hindernis worden overwonnen door state-of-the-art wetenschap en nieuwe juridische argumentaties. De stroom van nieuws over extreme weersomstandigheden die gemeenschappen verwoesten, verandert snel in een vloed. Klimaatwetenschap helpt te laten inzien dat dit niet louter pech is, maar onrechtvaardigheid. Dit zal de kansen voor eisers om te winnen in klimaatzaken blijven verbeteren. Een golf van nieuwe zaken komt eraan. De wet kan en zal niet onveranderd blijven.
