De legitimatie van het gebruik van geweld in het internationaal recht
Universeel Verbod op Geweld tussen Staten
Wist u dat er een verbod op geweld voor staten bestaat? Die kans is klein, tenzij u iets afweet van diplomatieke relaties en het Handvest van de Verenigde Naties. Wordt dat verbod in het dagelijkse leven dan ook gerespecteerd? Niet naar behoren. Het geweld tussen staten is alomtegenwoordig: oorlogen, bombardementen, invasies etc. Het is dagelijkse kost geworden. Maar als er een verbod op dit geweld bestaat, hoe kan het dan dat interstatelijk geweld zo frequent voorkomt?
Mogelijke argumenten voor geweldgebruik
Heeft u wel eens heftig zitten discussiëren over het wel of niet kunnen van een bepaalde gewelddadige actie van een staat? Of zitten luisteren naar zo’n discussie? Argumenten als ‘de staat moet zijn burgers beschermen’ of ‘ze kunnen die mensen daar toch niet zomaar aan hun lot overlaten’ vliegen dan over tafel. Voor veel van deze argumenten valt iets te zeggen, maar het meest waardevolle argument in deze discussies gaat uit van het Handvest van de Verenigde Naties. Iedereen heeft wel eens gehoord van de VN, maar slechts weinigen weten iets over haar historie of doelstellingen. En nog minder mensen zijn op de hoogte van het verbod op geweld tussen staten dat al in 1945 door de VN ingevoerd werd.
De creatie van de Verenigde Naties, het geweldverbod en zelfverdediging
In de eerste helft van de 20ste eeuw keek de wereld met lede ogen toe hoe twee gruwelijke wereldoorlogen miljoenen slachtoffers maakten. Na het einde van de Tweede Wereldoorlog beslisten de geallieerden dat zo’n huiveringwekkende oorlogen nooit meer mochten voorkomen. Dit resulteerde in de oprichting van de Verenigde Naties: een samenwerkingsverband tussen 50 staten die in het Handvest van de VN beloofden nooit nog geweld te gebruiken tegen een andere staat. Enkel indien een staat werd aangevallen door een andere staat, mocht zij zichzelf verdedigen. Deze handeling kan men vergelijken met een twist tussen twee buurmannen: wanneer de ene de andere plots aanvalt, mag de aangevallen buurman zich ook met geweld verdedigen tegen de andere buurman die de hem een kopje kleiner probeert te maken. Het concept van zelfverdediging kan dus worden toegepast op individueel maar ook op interstatelijk niveau.
Staten die achteraf lid werden van de VN, werden ook gebonden door het verbod op geweld. Vandaag telt de VN 193 staten, waardoor het verbod in zo goed als de hele wereld geldt.
Rol van de Veiligheidsraad van de VN
Zelfverdediging alleen kan echter niet de grote hoeveelheid interstatelijk geweld op onze nieuwspagina’s verklaren. Terecht: de tweede mogelijkheid voor geweldgebruik is namelijk de goedkeuring van de Veiligheidsraad van de VN. Als de Veiligheidsraad beslist dat een bepaalde situatie zodanig ernstig is dat op internationaal vlak moet worden ingegrepen, kan zij een gewelddadige tussenkomst autoriseren. Denk maar aan de eindeloze oorlog in Irak die de laatste twee decennia vele fases heeft doorlopen, denk aan Oost-Timor dat zich wilde afsplitsen van Indonesië, aan de crisis in Libië in 2011 en denk vooral aan de huidige erbamelijke situaties in Syrië, Yemen en dichter bij huis: Oost-Oekraïne. Wanneer een situatie zodanig uit de hand loopt dat een interne oplossing onmogelijk lijkt, grijpt de VN als wereldorganisatie in om de gemoederen te bedaren en landen in uitzichtloze situaties naar het licht aan het einde van de tunnel te leiden.
De aard van het beestje
De hiervoor geschetste regeling lijkt op het eerste zicht zeer duidelijk: geweld tussen staten is verboden. Als een men toch (onrechtmatig) aangevallen wordt, dan mag men zich als staat daartegen verdedigen. Loopt het uit de hand, dan grijpt de Veiligheidsraad in. Maar regels zouden geen regels zijn als niemand ze probeert om te buigen in zijn voordeel. En dat is ook het grote probleem bij dit geweldverbod en de bijhorende uitzonderingen.
Soms lijkt geweld een gemakkelijke en voordelige manier voor een staat om bepaalde doelen te bereiken. In dat geval laat zij zich veelal niet tegenhouden door het verbod, maar bedenkt allerlei smoesjes zodat wat zij doet toch legitiem lijkt. Hier komt het heikele punt van het systeem naar boven: de schemerachtige zone met concepten die voor discussie vatbaar blijven, als gevolg van een zeer beknopte verwoording van het verbod. Het merendeel van de nieuwspunten met betrekking tot geweld, die u dagelijks ziet passeren, vallen in deze categorie van twijfelgevallen.
Een nieuwe kijk op het nieuwsbericht?
Wanneer u vanavond opnieuw kijkt naar de eindeloze reeks bombardementen en interstatelijke conflicten die in het journaal passeren, zult u toch een luttele seconde langer stilstaan bij de gebeurtenissen van de dag. U weet nu namelijk dat er wel degelijk een geweldverbod bestaat op internationaal niveau. En u weet dat heel wat staten opportunistische argumenten zullen geven voor hun toch soms zeer bedenkelijke acties. Staten vertonen – logisch – de menselijke trekjes van hun leiders: ze willen regels voor iedereen behalve zichzelf en proberen steeds achterpoortjes in hun eigen voordeel te vinden. Op de weg naar wereldvrede is er dus nog heel wat werk aan de winkel om al die achterpoortjes voor eens en voor altijd af te sluiten…
