Achter de schermen bij Uber: Een Kwalitatieve inhoudsanalyse naar de ervaringen van Uber drivers in Frankrijk tussen 2019 en 2020 bekeken vanuit de Digital Market Manipulation Theory

De keerzijde van een Uber-rit

De ride-sharing applicatie Uber kampt de laatste jaren met een imagoprobleem. Er komt steeds meer kritiek op de manier waarop het bedrijf met haar gebruikers omgaat en de data van haar gebruikers verwerkt. Ook het statuut van de Uberchauffeurs (drivers) staat al lang ter discussie.

 

In augustus van dit jaar besliste een rechter in Californië dat Uberdrivers – mensen die als chauffeur werken via de applicatie Uber – onder het statuut van werknemer vallen. Dit is een belangrijke uitspraak want het betekent dat de chauffeurs nu recht hebben op overuren, ziekteverzekeringen en allerhande andere arbeidsvoorwaarden. Het statuut van de chauffeurs is reeds vele jaren een heikel punt voor de applicatie. Uber ziet zichzelf namelijk niet als werkgever maar eerder als intermediair platform tussen koper (klant) en verkoper (chauffeur).

 

Uber is in dat opzicht wat men in vakjargon een ‘Peer-to-Peer Sharing Network’ noemt. Het biedt een platform aan waarop potentiële verkopers, namelijk chauffeurs of drivers, verbonden worden met een groot aantal potentiële klanten (riders). Op de transacties tussen deze partijen neemt het bedrijf een commissie. Op deze manier fungeert de applicatie als “matchmaker” tussen klanten en hun chauffeurs. Zo claimt ze niet verantwoordelijk te kunnen worden gesteld voor de transportdiensten die deze chauffeurs aanbieden. Als intermediair platform (in plaats van werkgever) ontdoet Uber zich van alle verantwoordelijkheid wat betreft arbeidsvoorwaarden, wettelijke bepalingen inzake werknemersrechten én verschuiven ze de risico’s van zichzelf naar de drivers.

 

Machtspositie Uber

Naast de problematiek rond het statuut van de drivers klinkt er ook veel kritiek inzake de toegang tot informatie die Uber heeft en hoe de applicatie deze informatie gebruikt. Het verschil tussen de kennis die de Uber app heeft over haar gebruikers en de informatie waarover de drivers en riders zelf beschikken zorgt voor ongelijkheid. De Uber app, die werkt op basis van software en algoritmes, is immers “slimmer” dan de gebruikers van de app.

Deze ‘informatieasymmetrie’ kan leiden tot een luxueuze machtspositie voor Uber. Vanuit die positie kan ze haar drivers controleren, manipuleren of onder druk zetten. De drivers zijn namelijk afhankelijk van het platform om uitbetaald te worden en zijn bijgevolg genoodzaakt om naar Ubers pijpen te dansen.

Uber in Frankrijk

Sinds het ontstaan van Uber in 2009 kende het bedrijf een razendsnelle opmars. Na uitbreiding van de activiteiten in de Verenigde Staten werd Parijs in 2011 uitgekozen als debuutlocatie van de internationale expansie. Ondanks vele tegenkanting en tegenslagen omtrent de regulering van de applicatie is het bedrijf sinds zijn intrede in de Franse markt ontzettend gegroeid. Vandaag is Uber er actief in meer dan 20 verschillende steden en geldt Frankrijk, naast het Verenigd Koninkrijk, als een van de grootste internationale markten voor het bedrijf. Dit maakt van Frankrijk een ideale markt om de ervaringen van drivers te bestuderen.

Uit de ervaringen die Franse Uberdrivers met elkaar op online fora delen blijkt dat Uber haar machtspositie misbruikt en precaire werkomstandigheden in de hand werkt. Zo zijn er verschillende klachten over de uitbetalingen en transparantie vanwege Uber, alsook onvrede over het rating-systeem, de druk om ritten te aanvaarden en het fenomeen ‘Surge Pricing’.

 

Rating

Het valt op dat veel drivers gebukt gaan onder de stress van het evaluatiesysteem. Drivers worden op het einde van elke rit door hun klant geëvalueerd door middel van een ratingschaal waarbij de klant een score van 1 tot 5 sterren toekent. Deze methode van evalueren klinkt fair, maar wat vele klanten niet weten is dat Uber een minimumgemiddelde van 4,6 op 5 hanteert. Wanneer een driver onder dit gemiddelde zakt kan die zijn of haar toegang tot het platform (en dus ook inkomsten) verliezen. Vele klanten beseffen niet dat een score van 4/5 sterren een onvoldoende betekent, waardoor zij onterecht het gevoel hebben hun chauffeur een goede score toe te kennen.

Druk om ritten te aanvaarden

Uber ontzegt tevens veel drivers de toegang tot hun account wanneer zij te veel ritten ‘niet aanvaarden’. De druk die Uber op deze manier uitoefent is een schoolvoorbeeld van de asymmetrische machtsverhoudingen tussen de applicatie en haar drivers. Wanneer de applicatie een rit voorstelt heeft een driver maar 15 seconden om deze te aanvaarden, zonder te weten of de rit winstgevend zal zijn. De bestemming van de rit wordt immers niet gespecifieerd. Wanneer drivers te veel ritten ‘weigeren’ verliezen ze de toegang tot hun account en bijgevolg ook hun inkomstenbron. Op deze manier dwingt het algoritme de drivers om zoveel mogelijk ritten te aanvaarden ongeacht de bestemming van de rit, de lange werkuren, de rendabiliteit van de rit, etc.

Surge Pricing

Een van de duidelijkste voorbeelden die de manipulatie van Uber ten opzichte van haar drivers aantoont is het fenomeen van ‘Surge Pricing’. Het gaat hier om prijsverhogingen in bepaalde gebieden waar de vraag hoog en het aanbod laag is. Een driver kan op dat moment in dat gebied veel meer per rit verdienen dan op andere plaatsen. Al werkt de Surge Pricing-notificatie die Uber naar zijn drivers uitstuurt als een self-denying prophecy. Veel drivers begeven zich zo snel mogelijk naar het gebied waar een prijstoename te vinden is, waardoor het aanbod drivers enorm groeit en de prijs zich hierop weer normaliseert. Uber kan op deze manier zijn drivers bijna letterlijk van het kastje naar de muur sturen om een hoog aanbod voor de consumenten te garanderen.

 

Bovenop voorgenoemde voorbeelden blijkt het ook nagenoeg onmogelijk om als driver in contact te komen met Uber. Alle vragen of klachten worden gecounterd door middel van robotachtige standaardantwoorden. Van klassieke bedrijfsstructuur met managers en werknemers wil Uber niet weten, want het weigert de drivers als werknemers in plaats van ‘gebruikers van het platform’ te zien.

 

Tot op vandaag is het leven van een Uberdriver met andere woorden allesbehalve rozengeur en maneschijn. De recente uitspraak van de Californische rechter zou een eerste overwinning kunnen zijn in de strijd tegen de machtsongelijkheid tussen driver en platform.
